What Is a DUI Causing Serious Bodily Injury?

According to Florida Statute 316.193, a person has committed the criminal act of DUI causing serious bodily injury when they are driving a vehicle while impaired and they cause or in any way contribute to someone else’s serious personal injury.

To be convicted of DUI causing serious bodily injury, the prosecution must prove that:

  • The defendant was driving or in physical control of a motor vehicle
  • The defendant was under the influence of alcohol and his or her normal faculties were impaired while driving the motor vehicle
  • The defendant had a BAC of 0.08 or above
  • The defendant caused or contributed to the serious bodily injuries of another person while driving intoxicated

To be considered a cause of the serious bodily injury, your actions don’t need to be the only causal factor in an accident. It is enough for the prosecutor to show your actions led to the crash in some way. Simply deviating from the standard of care is enough.

Penalties for DUI Causing Serious Bodily Injury

In addition to the mandatory minimum sentence of 51 months in prison, the following penalties could also be added:

  • Up to five years in prison
  • Up to five years of probation
  • Up to a $5,000 fine
  • Driver's license revocation
  • Driver's vehicle impounded
  • Community service
